In accordance with Article Seven, Section 7.12 of the Declaration of Covenants, Conditions, and Restrictions for Gold Run Homeowners’ Association (the “Association”) hereby enacts the following set of Rules and Regulations governing all sections and phases of the Gold Run subdivision in Boulder County, Colorado.
A. VIOLATIONS
Initial Warning Letter. If a violation is found to exist, a warning letter shall be sent to the Owner of the Unit explaining the nature of the violation. This letter shall be sent via First Class Mail to the unit owner at the contact address on file with the HOA. Unless otherwise specified herein, the Owner will have 20 days from the date of the letter to ensure the violation is rectified. If the violation is not rectified or is repeated after 20 days, additional escalating violations may be imposed.
Hearing. The Owner of a unit issued a violation may request a hearing within 10 days of the date on the violation. If no hearing is requested within that time, the violation will be considered valid. A requested hearing will be scheduled and conducted by the Board of Directors, committee, or other person(s) as the Board sees fit. At such a hearing, the Owner may present evidence or statements explaining why the violation is unfair or invalid. A decision will be delivered to the Owner within 15 days after the hearing.
Fine Schedule. Unless a larger fine is identified in these Rules and Regulations, the following fine schedule has been adopted for all recurring covenant violations:
First Violation: Warning letter
Second Violation: $50.00
Third and subsequent violation: $75.00
Further Action. Third and subsequent violations maybe turned over to the Association’s attorney to take appropriate legal action. Serious infractions may be turned over immediately at the discretion of the Association.
Responsibility. Owners are responsible for the actions of all guests, renters, and occupants in their units. All fines are levied against the unit associated with the violation.
B. CONDOMINIUM UNITS & COMMON ELEMENTS
Occupancy. Only two unrelated persons may reside in a 1 or 2-bedroom residence or 3 unrelated persons in a 3-bedroom residence. Owners are subject to a fine $100 for each violation with additional fines of $50 per day if not remedied after 20 days.
Rental Length. Short-term rentals under 30 days are prohibited.
Decks. Decks must be kept clean and neat in appearance; this includes removing any small pets, leaves, or other debris on and in the immediate vicinity of the deck. Any deck drain shall be kept clean and clear of debris. Only the following items, or those allowed in section B, Paragraph 4, may be kept on decks, providing they are kept or installed neatly:
Patio Furniture.
Mats or rugs designed for outdoor use when placed flat on the floor and not substantially overlapping other mats or rugs.
Plants.
Bikes may be kept on decks provided they are not visible above the line of the deck railing unless hung from the ceiling above or wall.
Up to two strings of lights.
Outdoor temperature sensors.
Hammock mounting rings, provided the hammock itself is taken down when not in regular use.
Rings, hangers, and pots for hanging plants, provided the plants are well maintained during the growing season and taken down during the winter months.
Electric barbecue grills, provided they are inspected and stickered in compliance with Section 7.5 of the Amended and Restated Condominium Declaration for Gold Run Condominiums.
Common Areas. Common elements, e.g., under stairs, hallways, parking spaces and in front of units, may not be used for storage or trash. Any object found in a common area by the Association will be removed and stored or disposed of at Association’s discretion. A storage free of $50 will be charged to reclaim any confiscated items. If not claimed within 30 days, items may be disposed of as the Association sees fit. Any trash left in hallway will be hauled to trash and the Resident assessed a $25 fee after 1st notice and an opportunity for a hearing, and on each re-occurrence thereafter.
The following items are allowed to be neatly placed or installed within 6 inches of the main door of a unit, and may not extend more than 36 inches beyond the door laterally, or may be placed or installed on decks within the railing. They must not impede safety or the walking paths to other units, and must not violate fire code or other safety rules, regulations, or laws:
Shoe racks against the wall, extending out no further than 14 inches.
Door mats against the door threshold, and extending out no further than 24 inches.
Wreaths hung from the door.
Doorbells, including camera doorbells.
Video security cameras.
5. Signs. A single for rent or for sale sign measuring no larger than 24 inches by 36 inches may be placed in one window of a unit. A welcome sign no larger than 24 inches by 36 inches may be placed on each entry. A single sign or set of up to four individual numbers indicating the address of a unit, contained within a 24 inch wide by 36 inch tall area and no thicker than 1 inch may be placed in the area immediately adjacent to each entry. No other signs are permitted in Gold Run except for signs installed by the HOA and those permitted by state or federal statute
6. Structural Modifications. Interior structural modifications and any exterior modifications to units must have prior written consent of the architectural review committee.
7. Usage. Condominiums are for residential use only.
8. Barbecues. No charcoal or propane barbecues are allowed other than those provided by the Association. Highly flammable substances or devices with open flames or burners are prohibited on common or limited common areas. This includes, but is not limited to gasoline, kerosene, propane, hookah pipes, tiki torches, smokers, chimineas, and fire pits.

First Violation: $1,000
Second and Subsequent Violations: $2,000
9. Fireplaces. Use of indoor wood-burning fireplaces is prohibited in the community after May 23, 2024. Existing wood-burning fireplaces must be clearly placarded as inoperative, and either a) the flue physically rendered permanently closed and inoperative, b) converted to gas-only functionality, or c) converted to electric-only functionality, by that date.
10. Leaks. Any time a leak occurs, the Association shall investigate the cause. The Association shall then establish findings and either make appropriate repairs or notify any Owners impacted by the leak of its findings.
C. NUISANCES
1. Smoking. No Smoking of any kind—including, but not limited to, tobacco, marijuana, and vaping—is allowed on any deck or in any common areas. This includes the grounds. Cigarette butts or other smoking waste found on the ground or other common areas— including decks—which can be traced to a particular unit shall also be considered a violation of this rule.
Violations for this rule are as follows (please note, no warning letter is given):
First Violation: $150
Second and Subsequent Violations: $300
2. Noise. Residents shall exercise reasonable care to avoid disturbing, objectionable, or loud noises or music at any time. For incidents occurring between the hours of 10:00pm and 7:00 am a fine of $200.00 shall be levied without an initial warning letter being sent.

3. Projectiles. No resident shall throw, launch, shoot, or otherwise project any object, including pellets, BBs, fireworks, trash, or water balloons from a unit onto or at the common elements or at any individual within the community.
4. Damage to Common Elements. No resident shall cause or permit to be caused any damage to the common elements. In addition to the cost to repair any damages, the following fines will be incurred:

5. Other Acts. Any other act which annoys or acts to harass another resident within Gold Run as may be determined in the reasonable discretion of the Association.
D. VEHICLES AND PARKING
1. Speed. Any reports of careless driving will be reported to the Police. Speed limit in garages is 5 mph. 2. No Parking Areas. Parking is not permitted on lawns, in front of fire hydrants, fire lanes, garage doors, trash containers, blocking other vehicles, across yellow lines, where “no parking” notices are posted, or in other residents’ assigned parking spaces. Residents have the authority to tow vehicles through Boulder Valley Towing with proof of residency (such as a lease) if their personal vehicle is blocked in or someone is parking in their assigned spot.
3. Designated Parking. Vehicles shall be parked within designated parking spaces within the community. Each Resident shall use their assigned space for the primary parking.
4. Parking Space Usage. Parking spaces are for vehicles only. No other items may be stored there.
5. Visitor Parking. Vehicles parked in Gold Run Visitor/Open parking must adhere to the parking program currently used to enforce parking. Vehicles in violation of the system's rules may be tagged, booted, or towed at vehicle owner's expense.
6. Prohibited Vehicles. Except for first responder vehicles as defined by Colorado law, Commercial vehicles and any vehicle with a length greater than 236” or wider than 83” are not allowed on Gold Run property except of the express purpose of moving household goods, trash, or maintenance. No parking trailers, boats, or campers of any kind are allowed on Gold Run property.
7. Maintenance. Vehicle maintenance is not permitted on the Gold Run property other than changing of a flat tire. No disposal of oil, motor vehicle fluids, or other hazardous waste in trash containers or on Gold Run property is permitted.
8. Bicycles. Bicycles may be stored only in designated bicycle racks, in front of assigned parking spaces, or in residences. All bicycles are required to have a current Gold Run tag available at the Health Club around either their handlebars or seat post. Tag colors are changed annually. Any bicycle in violation of these rules will be tagged for 48 hours then have their lock cut and bike confiscated pursuant to section B.4. Any bike locked to any utility or drain line will be cut off and confiscated without warning.
9. Skateboards. No skateboards, kick scooters, roller blades/skates, bikes, or other wheeled devices shall be used in any way in which the device’s wheels leave the ground on Gold Run property.
E. ANIMALS
1. Dogs. Dogs are not allowed at any time anywhere at Gold Run unless legally required by the ADA. All ESA animals must be authorized by the Association.
2. Pets. Small animals generally recognizable as pets are allowed only in units. Pets are not allowed in hallways or common areas.

F. HEALTH CLUB
1. Memberships. Each Gold Run condominium unit may have as many Health Club memberships as permanent occupants provided that this number does not exceed the 4 Updated 3-6-2024 maximum occupancy rules contained herein. Proof of residency is required. Members must accept and abide by check-in system utilized. Non-occupant homeowners will retain their membership privileges.
2. Guests. Guests may only use the facilities when accompanied by a member. Up to 8 guest visits are allowed each month with no more than three guests per visit.
3. Attire. Appropriate shoes and upper torso garments, as well as tights, shorts or sweats must be worn in all workout areas except pool, hot tub and deck areas where only a swimsuit may be worn.
4. Lockers. Lockers are available to members and guests. All belongings not needed for activities should be kept in lockers not in the common areas.
5. Prohibited Items. Food, glass containers or canned beverages are not allowed into exercise areas, pool, steam rooms, saunas, or locker rooms. Alcohol, tobacco products, marijuana, and controlled substances are not permitted on the Health Club premises.
6. Entry. All members and guests must check in prior to using facility. None of the Gold Run facilities may be used while under the influence of drugs or alcohol.
7. Risk. All equipment is at user’s own risk. There is no lifeguard on duty. Swimming as at the sole risk of the individual. Running, on the pool deck and diving or jumping into the pool is not allowed.
8. Cleanliness. All equipment is to be wiped down after use with available cleaner. All equipment will be put away properly after use.
9. Maximum Time in Heat. For health and safety reasons, the maximum suggested time in steam rooms, saunas and hot tub is 30 minutes.
10. Lost and Found. Gold Run Health Club is not responsible for lost or stolen property. Any found property will be stored in our lost and found which is emptied at the end of each month.
11. Loaned Equipment. Equipment is offered for loan for checked-in members. Members are responsible for bringing equipment back in good condition.
12. Cell Phones. Cell phone usage shall remain courteous. No speaker phone usage is allowed in the Health Club.
13. Music. All music other than that provided within the Health Club must be through personal headphones or earbuds and must be at a volume inaudible from ten feet away.
14. Revoking Membership. Gold Run reserves the right to revoke Health Club membership at the discretion of the Association for those not in good standing with the association, violation of these Rules and Regulations, or behavior that is discourteous or threatening in any way.
